7. Intellectual Property

9.2 Digital Product Licence

Kaldarshak does not generally receive or store complete payment-card credentials where payment processing is handled by an external payment provider.

Subject to applicable law and the statutory rights available to consumers, any dispute arising out of or relating to the use of Kaldarshak, these Terms, or the purchase of products from Kaldarshak shall be subject to the jurisdiction of the competent courts and authorities in Amravati, Maharashtra, India.
Nothing in this clause is intended to prevent a consumer from exercising any mandatory statutory right to approach a competent consumer forum, commission, court, authority, or other dispute-resolution mechanism where such right is available under applicable law.
Where applicable law requires a dispute to be heard or resolved by a particular court, consumer commission, authority, or other forum notwithstanding this jurisdiction clause, the applicable legal requirement shall prevail.

The remaining provisions shall continue to apply.
34. No Waiver
If Kaldarshak does not immediately enforce a provision of these Terms, that does not mean that we waive our right to enforce the provision later.

These Terms, together with the Privacy Policy, Refund, Returns & Cancellation Policy, and any additional terms expressly applicable to a particular product or service, constitute the terms governing your use of Kaldarshak and your transactions with us, subject to applicable law.
